Property and Rental Period
The property known as La Jassine, Chemin de Faraud, Vaugines, France (the "Property") is offered for a fixed period vacation rental (the "Rental Period"), subject to confirmation by the owners, Sandra and Paul Beckett (the "Owners"), to the renters (the "Tenants"). The Rental Period shall commence at 4 pm on the first day (the "Arrival Time") and finish at 10 am on the last day (the "Departure Time"), the dates of the Rental Period being subject to confirmation by the Owners. The Owners shall be under no obligation to make the Property available to the Tenants before the Arrival Time and the Tenants shall vacate the Property before the Departure Time.
Deposit and booking confirmation
To reserve the Property, the Tenants shall pay a non-refundable deposit of 25% of the Total Fee, as defined hereunder (the "Deposit"). For the avoidance of doubt, the Property shall not be considered as reserved until reception of the Deposit by the Owners. Upon reception of the Deposit, the Owners shall send the Tenants an email confirmation of the booking.
Payment of Total Fee
The balance of the total booking fee, as indicated on the "Rates and Availability" page of the website www.lajassineprovence.com (the "Total Fee"), shall be paid by the Tenants not less than eight (8) weeks prior to the start of the Rental Period. Such deadline for payment of the balance of the Total Fee (the "Due Date") shall be indicated by email to the Tenants. Reservations made within eight (8) weeks of the start of the Rental Period require full payment at the time of booking. If payment is not received by the Due Date, the Owners reserve the right to cancel the reservation of the Property. For the avoidance of doubt, the Deposit shall in such case not be reimbursed to the Tenants, and the Tenants shall hold the Owners harmless of any and all liability and/or damages of any kind due to such cancellation.
In addition to the Total Fee, the Tenants shall pay a security deposit of 300 euros or equivalent (the "Security Deposit") to account for potential damages to the Property or its contents. It is agreed that the Owners shall refund the Security Deposit less any amounts for damages caused by the Tenants, for any necessary cleaning costs, and for any telephone usage during the occupancy.The Tenants acknowledge and agree that, the Security Deposit shall not limit the Tenants' liability to the Owners, and the Owners shall have the right to claim any additional amount to cover for damages or costs which exceed the value of the Security Deposit. In such case, the Owners shall send by email to the Tenants photographs or any other proof of damages, and the Tenants agree to pay the Owners the requested additional amount.
In the event of cancellation of the reservation by the Tenants prior to the Total Fee being paid by the Tenants (i.e. more than eight (8) weeks prior to the Arrival Time), the Tenants agree that the Deposit shall not be reimbursed. However, the Owners agree to consider reimbursement of the Deposit in case they are able to re-let the Property, deducted by any additional expenses incurred in re-letting the Property. In the event of cancellation of the reservation by the Tenants after payment of the Total Fee to the Owners, the Tenants agree that the Total Fee shall not be reimbursed. The Tenants acknowledge that the Owners shall have the right to cancel the reservation of the Property at any time and for any reason. In such case, and except if the cancellation is due to the Tenants not paying the Total Fee by the Due Date (in which case the Deposit shall not be reimbursed, as mentioned above), the Owners agree to reimburse the Tenants of the total amount paid, and the Tenants shall keep the Owners harmless of any liability and/or damages of any kind resulting from such cancellation.
The Owners shall not be liable to the Tenants (i) for any temporary defect or stoppage in the supply of public services to the Property or to any equipment, appliance, of amenity, (ii) for any loss, damage or injury which is a result of force majeure, or other matters beyond the control of the Owners. Under no circumstances shall the Owners' liability to the Tenants exceed the amount of the Total Fee. The Owners shall not be held responsible for theft, injury of any kind, or death of the Tenants whilst in the Property or in the Rental Period. The Tenants acknowledge that children must be supervised at all times.
The Tenants should arrange a comprehensive travel insurance policy (including cancellation coverage) and have full coverage for the Tenants' personal belongings, public liability, etc., since these are NOT covered by the Owners insurance. The Tenants agree to maintain the Property and all its contents in good order and to leave such Property and contents in the same condition in which they received them at the Arrival Time. The Tenants shall immediately notify the Owners of any defects or problems with the Property and/or equipment. The Tenants agree to respect the Owners' request that there be no smoking on the Property. No open fires are permitted on the Property. Children must be supervised at all times.
